Excellence in Regulatory Systems
The Excellence in Regulatory Systems Award, sponsored by the Ministry of Business, Innovation and Employment (Hikina Whakatutuki) and The Treasury (Kaitohutohu Kaupapa Rawa), recognises a policy reform, review or design initiative (at either a strategic or operational policy level) which improves the effectiveness of a regulatory system* in achieving its outcome.
Criteria
The extent to which the nomination provides evidence that:
- by applying a systems perspective which considers how the regulatory system operates as a whole
- considering the roles and responsibilities of different participants within the regulatory system and how they contribute to overall system outcomes
- based on analysis of system performance and evidence about how the system achieves or could achieve its outcomes
- demonstrates how the system sustains and improves performance over-time
- demonstrates best practice in consultation, and risk identification and mitigation.
* Regulatory system thinking involves:
- considering how effective a regulatory system is, looking across the range of instruments within the system (including legislation, regulation and tertiary instruments)
- taking into account the capabilities of regulators, parties with formal roles in a regulatory system (eg occupational or industry bodies) and regulated parties to fulfil the roles and responsibilities that the regulatory system places upon them
- treating a regulatory system as a living system, with regular attention paid to the performance of the system and where regulatory maintenance may be appropriate, consistent with the Government’s expectations for regulatory stewardship.
